01Acceptance of these terms
These Terms of Service ("Terms") are a binding agreement between you and Eukrasia Studio LLC ("we," "us," or "our"), the operator of the FelixFitness mobile application ("FelixFitness" or "the App"). By creating an account, accessing, or using the App, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use FelixFitness.
02Eligibility
You must be at least 18 years old to use FelixFitness. The App is intended only for adults, and by using it you represent that you are 18 or older and have the legal capacity to enter into these Terms. If you are using the App on behalf of someone else, you represent that you are authorized to do so.
03Your account
To use most features, you must create an account. You agree to provide accurate information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use. We are not liable for any loss arising from your failure to protect your account.
04License to use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use FelixFitness for your own non-commercial use. You agree not to copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the App, except where such restriction is prohibited by law. We may update, change, or discontinue the App or any feature at any time.
05Your content
FelixFitness lets you create and share content, including workouts, posts, comments, profile details, and images ("Your Content"). You retain ownership of Your Content.
By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute it solely as needed to operate and improve the App — for example, showing your posts to people you've shared them with. This license ends when you delete Your Content or your account, except for content others have already shared, copies retained for legal reasons, or residual backups that are overwritten over time.
You are solely responsible for Your Content and represent that you have the rights to share it and that it does not violate these Terms or any law. We do not endorse and are not responsible for content posted by users. We may, but are not obligated to, review, remove, or restrict content that we believe violates these Terms.
06Acceptable use
FelixFitness includes social features, and we want it to be safe and respectful. You agree not to:
Harass, bully, threaten, impersonate, or harm other users.
Post content that is unlawful, hateful, sexually explicit, defamatory, or that promotes self-harm or dangerous behavior.
Share spam, scams, advertising, or unsolicited promotional material.
Infringe anyone's intellectual property, privacy, or other rights.
Upload viruses or malicious code, or attempt to disrupt, overload, or gain unauthorized access to the App or its systems.
Collect or scrape other users' data, or use automated means to access the App without our permission.
Use the App for any illegal purpose or in violation of these Terms.
You can block other users and report content or behavior that violates these Terms. We may suspend or remove accounts that breach these rules.
07Health & fitness disclaimer
Please read this carefully
FelixFitness is a fitness-tracking and social tool, not a medical service. The App does not provide medical advice, diagnosis, or treatment, and nothing in it should be treated as a substitute for professional medical guidance.
Consult a qualified healthcare professional before beginning any exercise program or making changes to your fitness routine, especially if you have a medical condition, are pregnant, or have any concerns about your health. Never disregard professional medical advice or delay seeking it because of something in the App.
You participate in any physical activity at your own risk. To the fullest extent permitted by law, Eukrasia Studio LLC is not responsible for any injury, health condition, or loss that results from your use of the App or from activities you choose to undertake.
08Our intellectual property
The App itself — including its software, design, logos, branding, the name "FelixFitness," and all related content we provide (excluding Your Content) — is owned by Eukrasia Studio LLC or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without our prior written permission.
09Third-party services & app stores
FelixFitness relies on third-party services, including Amazon Web Services and Google Firebase, and is distributed through the Google Play Store. Your use of those services is also governed by their own terms and policies.
Google Play
You acknowledge that these Terms are between you and Eukrasia Studio LLC, not Google. Google is not responsible for the App or its content. The App is licensed to you, not sold. Your use of the App must also comply with the Google Play Terms of Service. Google is a third-party beneficiary of these Terms to the extent they concern your use of the App obtained through Google Play, and may enforce them.
10Disclaimers
To the fullest extent permitted by law, FelixFitness is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that any data will be accurate or preserved. You use the App at your own risk.
11Limitation of liability
To the fullest extent permitted by law, Eukrasia Studio LLC and its members, officers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim, or US $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
12Indemnification
You agree to indemnify and hold harmless Eukrasia Studio LLC and its members, officers, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, Your Content, your violation of these Terms, or your violation of any law or the rights of a third party.
13Suspension & termination
You may stop using FelixFitness and delete your account at any time, as described in our Privacy Policy. We may suspend or terminate your access, with or without notice, if you breach these Terms, create risk or legal exposure for us, or if we discontinue the App. Provisions that by their nature should survive termination — including content licenses already granted to others, disclaimers, limitation of liability, and indemnification — will continue to apply after your account ends.
14Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and may ask you to review and accept the new version within the App before you continue using it. Your continued use of FelixFitness after the changes take effect means you accept the revised Terms.
15Governing law & disputes
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the App will be resolved in the state or federal courts located in Virginia, and you consent to their jurisdiction, unless a mandatory law in your country of residence requires otherwise.
